Terms of Service

These Terms of Service (the "Terms") govern your use of the application "Vocatch" (the "App") provided by West Coast Developers ("we", "us", or "our"). By using the App, you ("you" or "the user") agree to these Terms and to the separately published Privacy Policy.

Article 1 (Application)

These Terms apply to all relationships between you and us regarding the use of the App.

Article 2 (Definitions)

For the purposes of these Terms:

  1. "Service" means the App and all services provided by us through the App.
  2. "Account" means the identification information issued for the purpose of using the Service.
  3. "Subscription" means a paid plan of the Service (such as Vocatch Plus).

Article 3 (Account Registration)

  1. To use the Service, you shall register an Account using anonymous sign-in, your Google Account, or your Apple ID.
  2. You must be at least 13 years of age. The Service is not available to users under 13.
  3. You are solely responsible for managing your Account and shall not lend, transfer, or share it with any third party.

Article 4 (Paid Subscription)

  1. Certain features of the Service ("Plus Features") are available through a paid Subscription.
  2. The price, billing period, and contents of the Subscription are displayed on the in-app purchase screen.
  3. Payments are charged to your Apple ID or Google Account.
  4. Your Subscription will automatically renew at the same price unless you cancel at least 24 hours before the end of the current billing period. The renewal charge will be processed within 24 hours before the end of the current period.
  5. You may cancel your Subscription at any time after purchase from your App Store or Google Play account settings.
  6. If a free trial is offered, any unused portion of the trial is forfeited at the moment you purchase a Subscription.
  7. Refunds are governed by the terms and refund policies of the App Store or Google Play; we do not provide individual refunds.

Article 5 (Prohibited Conduct)

You shall not engage in any of the following while using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that infringe the intellectual property rights, privacy rights, or other rights of us, other users, or third parties
  4. Decompiling, reverse-engineering, or modifying the source code of the App
  5. Acts that interfere with the operation of the Service (unauthorized access, excessive requests, unauthorized data extraction, etc.)
  6. Using the Service for commercial purposes without our prior written permission
  7. Any other conduct that we deem inappropriate

Article 6 (User Content)

  1. The rights to data registered by you in the App, such as words and learning history ("User Content"), belong to you.
  2. You grant us a license to use User Content to the extent necessary to provide the Service (cross-device synchronization, backup, generation of review recommendations, etc.).

Article 7 (Intellectual Property)

  1. All copyrights, trademarks, and other intellectual property rights in the App, the built-in dictionary data, UI design, logos, and any other content constituting the Service belong to us or to the third parties holding those rights.
  2. You shall not reproduce, distribute, modify, or use such content for secondary purposes beyond what is necessary to use the Service.

Article 8 (Third-Party Services)

  1. The App is distributed through the App Store provided by Apple Inc. and Google Play provided by Google LLC. By using the App, you also agree to comply with the terms of these platform providers.
  2. The App uses third-party services such as Firebase (provided by Google LLC). For details, please refer to our Privacy Policy.

Article 9 (Changes, Suspension, and Termination of the Service)

  1. We may change, add, or remove features of the Service without prior notice.
  2. We may temporarily suspend all or part of the Service for maintenance, system failures, or other unavoidable reasons.
  3. We may terminate the Service by giving reasonable advance notice.

Article 10 (Account Termination and Suspension)

  1. You may end your use of the Service at any time by deleting your Account from the in-app settings.
  2. We may suspend or delete your Account without prior notice if you violate these Terms or for any other reasonable cause.

Article 11 (Disclaimer)

  1. The Service is provided "as is". We make no warranty as to its completeness, accuracy, usefulness, fitness for a particular purpose, or freedom from errors.
  2. We are not liable for any loss, corruption, or synchronization failure of data within the Service. You are responsible for performing your own backups as necessary.
  3. We are not liable for any damages arising from interruption, suspension, or termination of the Service.

Article 12 (Limitation of Liability)

  1. Except in cases of our willful misconduct or gross negligence, our liability to you in connection with the Service shall be limited to the total Subscription fees you paid to us during the twelve (12) months immediately preceding the occurrence of the relevant damage.
  2. This Article shall not apply to the extent it conflicts with the Consumer Contract Act or any other mandatory provision of law.

Article 13 (Changes to These Terms)

We may modify these Terms when we deem it necessary by giving prior notice to users. The modified Terms shall take effect from the time they are posted within the App or on this website.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any dispute between us and you arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
